This privacy policy is intended to give you an understanding of how and why we use the information that you give us.

Imperial English UK keep information about individuals that includes learners, staff, business owners, consultants, business and academic individuals. It is important to us that we protect your privacy and personal data.

When you join us, use our website and social media pages or provide us with your information you are consenting to this privacy policy and the ways in which we use your information as outlined in this policy. If you do not agree with this policy then please do not give us your information or use our products, services, sites and social media.

What we do

We provide English language learning and teaching services in the UK and overseas. The services include setting up the academies, offering courses, organising short UK visits, delivering teacher training programmes and providing consultancy services for education related projects and activities.

What we recognised

The Data Protection Act protects individuals’ rights concerning information about them held by us. We respect its legal obligations to protect that information under the Data Protection Act 1998.

What is Personal Data?

Personal Data is defined as “any information relating to a person”.

The definition of personal data is quite broad and the personal data we collect from the user will vary depending on the context of interactions with us and the services that we are providing to you. It may include, but is not limited to, the following information:

Personal and Contact Data: application documents, payment information, sponsorship information, qualifications, transcripts, references, visa information, agents, classes, reports, registers and any correspondence, feedback, survey responses and any usernames, use of our website, products, services, medical reports on health, ongoing treatment, involvement in criminal activities.

Main purposes: To assess applications from candidates for admission and assist in the admissions process; accommodation issues; to process proper and up to date records of academic progress; fees and charges administration/collection; administration; legal issues and obligations (eg Health & Safety record); communications/mailings; references; disciplinary matters; legal obligations, provision of healthcare, registration with NHS, registration with local police, accommodation provision, decision making process and business activities.

Main sources and disclosures: Applications forms (paper copy and online), Inquiry Forms (online); Inquiry calls, personal visits, family; local authority (and other governmental bodies); examinations results; scholarships; student sponsors, other examination boards; other educational institutions; employers; legal representatives; admissions officers; data subject; websites, referral.

How we use your information

Our website offers the possibility to share content on social media channels, e.g. Facebook. The respective social media provider will directly gather the learner's personal data only after the learner is registered as a visitor to their site. Please refer to the privacy policy of the social media providers to learn more about what personal data is collected and used.

We do not:

analyse your personal information as part of any profiling

use any kind of automated decision-making

make use of any other additional external information about our users, either obtained directly or via third parties

pass this personal data onto any third party unless it is necessary to carry out the service you have requested.

Your consent

We will ask for consent at the point of collecting your data. Sometimes we may process data without consent when we are legally allowed to do so and where it is in our interests. This is provided we respect your rights.

You can withdraw your consent at any time, note this may mean withdrawal of access to certain products and services. If you want no further contact from us, and if we are legally required to store the information this will continue to be saved until the legal expiry date and we will keep basic contact information in order to stop sending you unwanted materials in future, and to ensure that we do not accidentally store details for the same person multiple times.

How long do we keep your data for?

We will only keep your information for as long as we need it to provide you with the services or information you have requested, to administer your relationship with us, to comply with the law, or to ensure we do not communicate with people that have asked us not to. When we no longer need this information we will dispose of it securely.

What are the fees and duration for data access?

We are usually able to provide personal data within a month of the initial request. There is no fee for this service.

Where do we store your personal data?

Your information may be kept on paper, on computers/the Cloud. The data may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by persons operating outside the EEA. If we do send your personal data outside the EEA we will ensure that the recipient implements appropriate measures to protect your information. By submitting your details you agree to this transfer.

All information you provide to us is stored on our secure servers.

The internet is not completely secure. We will do our best to protect your personal data, but we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. The purpose of this document is to provide guidance on when refunds of course fees will be made by Imperial English UK and how they will be calculated, following the withdrawal or suspension of courses. This policy relates to the portion of the fee that is paid directly by the student, participants or by a sponsor.

A. Online Courses

By booking for an Online Course and making a payment of full or instalment fee, you agree to the following Terms and Conditions: Under this refund policy and under guidance of the Consumer Contracts Regulations 2013, you have the right to cancel your booking at any time at the following terms:

1. If you cancel the course booking within 14 calendar days of registering your confirmation and before the start of the course without giving any reason, you are entitled to a full refund of the fee paid.
2. Cancellations and refunds in circumstances outside those described above, and/or following the expiry of the 14-day cancellation period, are subject to the terms and conditions set out in this Cancellation, Postponement and Refund Policy. For the avoidance of doubt, the cancellation period will expire 14 days after the date of the registration confirmation.
3. Once you begin the course, you are no longer eligible for a full refund, even if you ask for a refund within 14 days of payment.
4. Once a course has been redeemed, we cannot grant a refund.
5. All refund requests should be sent to admin@imperial-english.co.uk or posted to Imperial House, 126 Petersfield Road, Birmingham, B28 0BD.
6. Any refund will take up to 30 days to process.

B. Classroom Courses

By booking on a classroom course and making a payment in full or in instalments, you agree to the following Terms and Conditions.Under this refund policy and under guidance of the Consumer Contracts Regulations 2013, you have the right to cancel your booking at any time at the following terms:

1. If you cancel the course booking within 14 calendar days of registering your confirmation and before the start of the course without giving any reason, you are entitled to a full refund of the fee paid.
2. Cancellations and refunds in circumstances outside those described above, and/or following the expiry of the 14-day cancellation period, are subject to the terms and conditions set out in this Cancellation, Postponement and Refund policy. For the avoidance of doubt, the cancellation period will expire 14 days after the date of the registration confirmation.
3. Imperial English UK reserves the right to reschedule any classroom course without prior notice.
4. Imperial English UK reserves the right to change the tutor stated on the course page without prior notice.
5. All refund requests should be sent to admin@imperial-english.co.uk or posted to Imperial House, 126 Petersfield Road, Birmingham, B28 0BD.
6. Any refund will take up to 30 days to process.

C. Live Online Courses / workshops / seminars

By booking on live online courses, workshops, seminars, trainings, and making a payment in full or in instalments, you agree to the following Terms and Conditions.

Under this refund policy and under guidance of the Consumer Contracts Regulations 2013, you have the right to cancel your booking at any time at the following terms:

1. If you cancel the course booking within 14 calendar days of registering your confirmation and before the start of the course without giving any reason, you are entitled to a full refund of the fee paid.
2. Cancellations and refunds in circumstances outside those described above, and/or following the expiry of the 14-day cancellation period, are subject to the terms and conditions set out in this Cancellation, Postponement and Refund Policy. For the avoidance of doubt, the cancellation period will expire 14 days after the date of the registration confirmation.
3. You may reschedule the course up to 7 days before the start date of the course at no additional cost.
4. Imperial English UK reserves the right to reschedule any online course without prior notice.
5. Imperial English UK reserves the right to change the tutor stated on the course page without prior notice
6. All refund requests should be sent to info@imperial-english.co.uk or posted to Imperial House, 126 Petersfield Road, Birmingham, B28 0BD.
7. Any refund will take up to 30 days to process.

D. Studying courses on apps (course apps)

By downloading the course apps from the Apple Store, Google PlayStore or our website and making a payment in full, you agree to the following Terms and Conditions.

There are two ways for you to cancel the course subscription and get a refund. The cancellation and refund methods differ based on the way you have subscribed to the App:

1. If you have purchased your subscription via our website: We grant you the option to cancel the subscription and receive a refund provided that you are not satisfied with the App. However, this cancellation option is subject to several conditions:
• You must contact us within 5 days of the initial purchase and before the end of your subscription term.
• You can demonstrate that you have followed the customised / purchased course for 5 consecutive topics (e.g., by showing your tracking data). Following the receipt of your refund application, we will notify you by email if it is approved. We will use your original payment method for the refund. Typically, it takes around 30 days to process the refund.
• Please be aware that your purchased subscription does not cancel automatically if you delete the App. You should cancel the subscription before deletion of the App.
2. If you have purchased a subscription via any app distribution plat-form (Apple Store, Google PlayStore, etc.):
• You can cancel your subscription with your app distribution platform by reaching out to Apple or Google (or other applicable app distribution platforms) directly with any refund requests. For example, Apple is typically able to honour all refund requests within 30 days of the purchase date (at their discretion). Customers who subscribed to Simple through Google Play will need to follow instructions at https://support.google.com/googleplay/answer/2479637.
• All refund requests should be sent to admin@imperial-english.co.uk or posted to Imperial House, 126 Petersfield Road, Birmingham, B28 0BD.

E. Cancellation by Imperial English UK

Whilst every effort is made to avoid changes to our courses, workshops, seminars, and trainings, Imperial English UK reserves the right to withdraw or cancel any course. If for any reason we cancel a course, all course fees will be returned in full.

F. Refund Calculation and Terms

1. All refunds will be calculated in UK Sterling. The Imperial English UK will not refund any shortfalls due to exchange rate fluctuations, or offer compensation for any bank or other charges incurred. Bank charges will be deducted from the refund.
2. Where payment of tuition fees was split between more than one payee, any refund due will be made in proportion to the original split.
3. Cash refunds cannot be made.
4. Documentary evidence of sponsorship is required before any refund of personal contributions towards fees can be considered. This may include copies of award notices from funding bodies, or letters from sponsors confirming details of the fee support to be provided.
5. All refunds will be paid back using the original payment method, i.e. if paid by bank transfer, it will be refunded back to the same bank account.

G. IMPORTANT STATEMENT

The Refund Policy shall be effective as of August, 2022 The Refund Policy is an integral part of the Terms of Use and shall be binding for the users upon the acceptance of the Terms of Use. Any translation from the English version is provided for your convenience only. In the event of any discrepancies between the English version and any other translated version, the English version shall prevail.

Use of Imperial English’s official pages on social media platforms (such as our Facebook page at https://www.facebook.com/) and to your use of social media to interact with Imperial English UK. Each social media website may have its own terms of use (and privacy and cookies policies) that will also apply to your use of those sites.

LICENSE

The Apps, portals and websites are licensed, not sold, to you by Imperial English UK for use strictly in accordance with the terms of this Agreement.

Imperial English UK grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Apps, portals and websites solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

These Terms of Use apply regardless of the sort of device you are using to access Imperial English Digital Services.

ACCESSING IMPERIAL ENGLISH DIGITAL SERVICES

You must behave in a respectful way to all other users of Imperial English UK Digital Services. Treat information you obtain from Imperial English Digital Services with respect and use it only as permitted under these Terms of Use.

You must not:

make sure that all details you provide during the registration process (including any details about your age) are truthful and accurate;

let us know promptly if any of the details you have provided stop being accurate;

use an appropriate profile name. You must not pretend to be someone else or try be entirely responsible for any activity that occurs under your profile name;

keep secret your login details (including your password) - you must change your password if you believe it is no longer a secret;

set up no more than one account for each Imperial English UK Digital Service; and tell us as soon as you can if you become aware of any unauthorised use of your account.

OWNERSHIP OF INTELLECTUAL PROPERTY RIGHTS

Imperial English UK is the owner or the licensee of all intellectual property rights in Imperial English UK Content and in the design, structure, ’look and feel’ and the arrangement of Imperial English UK Digital Services.

This Agreement shall remain in effect until terminated by you or Imperial English UK. Imperial English UK may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from Imperial English UK, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Imperial English UK digital services and all copies thereof from your mobile device or from your computer.

Upon termination of this Agreement, you shall cease all use of the Imperial English UK digital services and delete all copies of the Imperial English UK Digital Services from your mobile device or from your computer.

Termination of this Agreement will not limit any of Imperial English UK’s rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

GOVERNING LAW

The laws of England and Wales apply. These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, these Terms of Use and/or any Imperial English UK Digital Services. This means that all claims relating to these Terms of Use and/or Imperial English UK Digital Services can be settled by a judge (or a number of judges) in an English court. However, Imperial English UK retains the right to bring proceedings against you for breach of these Terms of Use in your country of residence or any other relevant country.

ENTIRE AGREEMENT

Some Imperial English UK Digital Services and Imperial English UK Content will only be available if you have paid for access to them. In these circumstances, additional terms and conditions that apply to your purchase of relevant Imperial English UK Digital Services and Imperial English UK Content will be drawn to your attention before you make your purchase, and you will be asked to confirm your agreement to those additional terms. These Terms of Use will also apply to the contract between you and the Imperial English UK for the purchase of any Imperial English UK Digital Services and Imperial English UK Content (unless, and only to the extent, there is any inconsistency with the additional terms that we draw to your attention at the time of purchase).

By continuing to access or use our digital services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the digital services.

The Terms of Use may change from time to time and, if they do, the up-to-date version will always be available on www.imperial-english.com (and we will always make the up-to-date version of the Terms of Use available to you through Imperial English UK Digital Services).

Any revised version of these Terms of Use will be effective immediately when it is displayed on www.imperial-english.com
